These Terms of Service (“Terms”) govern your access to and use of the Zeroply website, online store, products and related services (“Services”).
The Services are operated by ZEROPLY PTY LTD (ABN 75 698 579 494), referred to in these Terms as “Zeroply”, “we”, “us” or “our”.
By accessing our website, creating an account, placing an order, purchasing a product or otherwise using our Services, you agree to these Terms and our:
- Privacy Policy;
- Refund and Returns Policy;
- Shipping Policy; and
- Product-specific directions, warnings and conditions.
If you do not agree to these Terms, you must not use our Services or purchase our products.
1. Australian Consumer Law
Our products and Services come with consumer guarantees that cannot be excluded under the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Nothing in these Terms excludes, restricts or modifies:
- A consumer guarantee;
- A right or remedy under the Australian Consumer Law; or
- Any other right, guarantee, condition, warranty or liability that cannot lawfully be excluded, restricted or modified.
Every exclusion and limitation in these Terms applies only to the maximum extent permitted by law.
2. Eligibility
You must be at least 18 years old to purchase our products unless the product packaging and applicable law expressly permit otherwise.

- You will use the products only for their intended purpose;
- You will comply with all directions and warnings; and
- You will not purchase or use our products for an unlawful purpose.
We may refuse, limit, suspend or cancel an order where we reasonably suspect:
- Fraudulent or unauthorised activity;
- A breach of these Terms;
- Commercial resale that we have not authorised;
- Misuse of a promotion;
- A risk to customer safety; or
- Unlawful conduct.
3. Product nature and intended use

Our products are not intended to diagnose, treat, cure or prevent any disease or medical condition.
Information provided through our website, packaging, advertising, social media, customer support or other communications is general information only. It does not constitute medical, nutritional or other professional advice.
Individual experiences and results may vary. We do not guarantee:
- Any specific health or wellbeing outcome;
- Any particular fitness or performance result;
- Weight loss or body-composition changes;
- That a product will be suitable for every individual;

- Stop using a product if you experience an unexpected or adverse reaction.
You must not misuse, alter, contaminate, repackage or consume a product in a manner inconsistent with its instructions or intended purpose.
5. Medical and professional advice
You should obtain advice from a qualified healthcare professional before using our products if you:

Our employees, contractors, ambassadors, influencers and customer-service representatives are not authorised to diagnose a condition, provide medical advice or determine whether a product is medically suitable for you.
Reliance on general information supplied by Zeroply is at your own risk, subject to any liability that cannot lawfully be excluded.
6. Allergies and intolerances
You are responsible for reviewing the complete ingredient list and allergen information before purchasing and consuming a product.
Products may be manufactured, processed, packed, handled or stored in facilities that also handle allergens. You must review any allergen or cross-contamination warning displayed on the product.
Do not consume a product if:
- You are allergic or sensitive to an ingredient;
- You have been advised not to consume an ingredient;
- The packaging seal is broken or appears tampered with;
- The product appears contaminated or unsafe;
- The product has expired; or
- You cannot confirm that it is suitable for you.
Stop using the product if you experience an unexpected reaction.
Seek urgent medical assistance if you experience a serious or potentially life-threatening reaction. Contact us at info@zeroply.com.au if you believe a product is contaminated, incorrectly labelled or unsafe.
7. Pregnancy and breastfeeding
Unless the product label expressly states otherwise and a qualified healthcare professional confirms that the product is suitable, our products should not be used during pregnancy or breastfeeding.
To the maximum extent permitted by law, Zeroply is not responsible for harm caused by using a product contrary to its directions, warnings or professional medical advice.
This does not exclude liability that cannot lawfully be excluded.
8. Assumption of risk
By purchasing or using a Zeroply product, you acknowledge that:
- Products may affect individuals differently;
- No particular outcome is guaranteed;
- You are responsible for determining whether the product is suitable for you;
- You must follow all directions, warnings and storage requirements;
- You are responsible for obtaining professional advice where appropriate; and
- You accept the ordinary and clearly disclosed risks associated with using the product.
This assumption of risk does not exclude any right, guarantee or remedy that cannot lawfully be excluded.
9. Product information
We take reasonable steps to ensure that product descriptions, photographs, ingredients, warnings, quantities, packaging information and prices are accurate.
However:
- Colours may appear differently depending on your screen;
- Packaging and product presentation may be updated;
- Minor differences may occur between production batches;
- Product availability may change;
- Images may be illustrative; and
- Typographical or technical errors may occasionally occur.
You must review the information on the physical product label before use.
If information on our website materially conflicts with the product packaging, do not use the product and contact us.
Nothing in this section permits Zeroply to provide false, misleading or deceptive information or excludes your rights where a product does not match its description.
10. Orders
Submitting an order is an offer to purchase the selected products.
An order is not accepted until:
- Payment has been authorised;
- We have reviewed the order;
- We have confirmed its acceptance; and
- The products have been allocated for fulfilment.
We may reject or cancel an order before dispatch where:
- A product is unavailable;
- A price or product description contains an obvious error;
- Payment cannot be authorised;
- The order appears fraudulent or unauthorised;
- Purchase limits have been exceeded;
- A promotion has been misused;
- We cannot lawfully supply the product; or
- Fulfilling the order may create a safety or legal risk.
If we cancel a paid order before supply, we will refund the amount paid for the cancelled product.
11. Prices and payments
Unless stated otherwise:
- Prices are displayed in Australian dollars;
- Applicable GST is included;
- Delivery costs are calculated separately; and
- You must pay the complete amount displayed at checkout.
You authorise us and our payment providers to charge your selected payment method.
You are responsible for any fees imposed by your financial institution, including currency-conversion, international-transaction or dishonour fees.
We may correct an obvious pricing error before accepting an order. If payment has already been processed, we will allow you to pay the correct price or receive a refund.
12. Promotions and discount codes
Promotions and discount codes:
- Are subject to their stated conditions;
- May have an expiry date;
- May apply only to eligible products or customers;
- Cannot be exchanged for cash;
- Cannot be combined unless expressly permitted;
- Must not be sold, copied or obtained fraudulently; and
- May be withdrawn where affected by fraud, misuse or an obvious error.
We may reject or cancel an order involving fraudulent or unauthorised use of a promotion.
Withdrawal of a promotion will not affect an order we have already accepted unless permitted by law or the promotion was obtained through fraud or misuse.
13. Shipping and delivery
Delivery dates and timeframes are estimates unless we expressly agree otherwise.
We will take reasonable steps to process and dispatch orders within the timeframes displayed on our website.
To the maximum extent permitted by law, we are not responsible for delays caused by circumstances outside our reasonable control, including:
- Carrier delays;
- Severe weather;
- Natural disasters;
- Industrial action;
- Government restrictions;
- Customs delays;
- Transport disruption;
- Supply-chain interruption; or
- Incorrect delivery information provided by the customer.
Nothing in this section excludes your rights where we fail to supply an order within a reasonable period or otherwise fail to comply with a consumer guarantee.
14. Incorrect delivery information
You are responsible for providing accurate and complete delivery information.
Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.
If an order cannot be delivered or is returned because you provided incorrect or incomplete information, we may require you to pay reasonable redelivery costs.
To the maximum extent permitted by law, Zeroply is not responsible for delays, additional costs or non-delivery caused solely by inaccurate or incomplete information supplied by you.
15. Missing, damaged or incorrect deliveries
You must contact us as soon as reasonably possible if:
- Your order is materially delayed;
- Your parcel appears to be missing;
- A product arrives damaged;
- You receive the wrong product;
- You receive an incorrect quantity; or
- Your order is incomplete.
We may request photographs, packaging information, delivery evidence or other reasonable information to investigate.
Where we or a provider acting on our behalf caused the problem, we will provide the remedy required by applicable law.
16. Risk and ownership
Subject to applicable law, risk in a product passes to you when it is delivered to:
- You;
- A person authorised by you; or
- A safe location or collection point nominated by you.
Ownership passes when we receive complete payment and the product is delivered.
This section does not exclude our responsibility for damage, loss or non-delivery occurring before risk lawfully passes to you.
17. Storage and handling
Products must be stored and handled according to their packaging.
Unless the product label states otherwise, products should be:
- Stored below 25°C;
- Kept in a cool and dry place;
- Protected from direct sunlight;
- Kept in their original packaging;
- Properly sealed after opening; and
- Kept out of reach of children.
To the maximum extent permitted by law, we are not responsible for melting, warping, contamination, deterioration or other damage caused after delivery by:
- Exposure to excessive heat;
- Exposure to sunlight;
- Leaving products in a vehicle;
- Exposure to moisture;
- Improper storage;
- Mishandling;
- Failure to reseal the packaging; or
- Failure to follow the product instructions.
This exclusion does not apply where the product was damaged before or at delivery, was inadequately packaged or otherwise failed to comply with a consumer guarantee.
18. Changes and cancellations
If you want to change or cancel an order, contact us immediately at info@zeroply.com.au.
We will attempt to accommodate your request but cannot guarantee that an order can be changed or cancelled after processing or dispatch has commenced.
If we agree to cancel an order before dispatch, we will refund the relevant amount using the original payment method.
19. Change-of-mind returns
We do not provide refunds, exchanges or store credits merely because you:
- Changed your mind;
- No longer want or need the product;
- Selected the wrong product, flavour or quantity;
- Found the product cheaper elsewhere;
- Do not like the product’s taste, texture or ordinary effects; or
- Did not achieve your preferred or expected result.
Please review all product information before completing your purchase.
This change-of-mind policy does not affect any rights you have under the Australian Consumer Law.
20. Consumer guarantees and faulty products
Products purchased from Zeroply come with consumer guarantees that cannot be excluded.
Among other requirements, products must:
- Be of acceptable quality;
- Be reasonably safe and durable;
- Be fit for their usual purpose;
- Be fit for a disclosed purpose where the relevant legal requirements are met;
- Match their description;
- Match any applicable sample or demonstration model; and
- Comply with applicable express warranties.
If a product fails to comply with a consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation or compensation.
The available remedy depends on whether the problem is major or minor and the circumstances of the transaction.
21. Major problems
A product may have a major problem where it:
- Is unsafe;
- Is significantly different from its description;
- Has one serious problem or several smaller problems that would have stopped a reasonable consumer from purchasing it;
- Is substantially unfit for its usual purpose and cannot easily be made fit within a reasonable time; or
- Is substantially unfit for a purpose made known before purchase and cannot easily be made fit within a reasonable time.
Where a product has a major problem, you may reject it and choose between:
- A refund; or
- A replacement of the same type and similar value, where reasonably available.
You may also be entitled to compensation for reasonably foreseeable loss or damage caused by the failure.
22. Minor problems
Where a product has a minor problem, we may choose to provide a repair or another appropriate remedy within a reasonable period.
Because some products are consumable and cannot practically be repaired, the appropriate remedy may be a replacement, refund or another remedy required by law.
If a minor problem cannot be remedied within a reasonable period, you may be entitled to reject the product and receive a refund or replacement in accordance with the ACL.
23. Making a consumer claim
If you believe a product is faulty, unsafe, damaged, incorrectly supplied or does not comply with a consumer guarantee, contact us at info@zeroply.com.au.
Please provide:
- Your name and contact details;
- Your order number or proof of purchase;
- A description of the problem;
- The date you noticed it;
- Photographs or videos, where reasonably available;
- Information about how the product was stored or used, where relevant; and
- Any batch number, expiry date or packaging information requested by us.
We may inspect or assess the product before providing a remedy.
You should contact us promptly, but your rights under the ACL are not restricted to a fixed seven-day period.
24. Opened or consumed products
For health, hygiene and safety reasons, we do not accept opened, used or partially consumed products solely because the customer changed their mind.
However, an opened, used or partially consumed product may still qualify for a remedy if it fails to comply with a consumer guarantee.
Stop using the product and contact us if you believe it is faulty, contaminated, incorrectly labelled or unsafe.
25. Return costs
Where a product fails to comply with a consumer guarantee, Zeroply will bear reasonable return costs where required by law.
We may:
- Provide a prepaid return label;
- Arrange collection;
- Reimburse reasonable postage; or
- Use another reasonable return method.
Contact us before returning a product so we can provide the correct return instructions.
If the product complies with the consumer guarantees and the issue was caused by misuse, improper storage or another matter for which we are not responsible, you may be responsible for reasonable return or redelivery costs where permitted by law.
26. Maximum lawful exclusion of liability
To the maximum extent permitted by law, ZEROPLY PTY LTD and its directors, officers, employees, contractors, representatives, agents and related entities exclude all representations, guarantees, conditions, warranties and liabilities that may lawfully be excluded.
To the maximum extent permitted by law, ZEROPLY PTY LTD will not be liable for any loss, injury, illness, adverse reaction, expense, cost, damage, delay or claim arising from or connected with:

- Failure to review ingredients or allergen information;
- Use by a person with a known allergy, sensitivity or contraindication;

28. Liability cap
To the maximum extent permitted by law, ZEROPLY PTY LTD’s aggregate liability arising from or connected with a product, order or transaction is limited to the amount paid for the affected product.
Where a guarantee concerning goods applies and the law permits us to limit our liability, our liability is limited, at our option, to:
- Replacing the goods;
- Supplying equivalent goods;
- Repairing the goods;
- Paying the cost of replacing the goods or acquiring equivalent goods; or
- Paying the cost of having the goods repaired.

29. Liability that cannot be excluded
Nothing in these Terms excludes, restricts or modifies:
- Consumer guarantees under the Australian Consumer Law;
- A right or remedy that cannot lawfully be excluded;
- Liability for fraud or fraudulent misrepresentation;
- Liability arising from deliberate or wilful misconduct; or
- Any other liability that applicable law prohibits us from excluding.
Where liability cannot be excluded but may lawfully be limited, ZEROPLY PTY LTD’s liability is limited to the fullest extent permitted by law.
30. Customer indemnity

- Your unlawful use of the Services;

- Your infringement of another person’s rights;
- Unauthorised resale, alteration or representation of our products;
- Content you submit that is unlawful or infringes another person’s rights; or

- Using a strong and unique password;
- Keeping your account information accurate;
- Preventing unauthorised access to your device; and
- Notifying us promptly of suspected unauthorised access.
To the maximum extent permitted by law, we are not responsible for unauthorised account activity caused solely by your disclosure of credentials or failure to take reasonable security precautions.
33. Reviews and customer content
If you submit a review, photograph, video, testimonial or other content, you confirm that:
- You created it or have permission to use it;
- It is truthful and based on a genuine experience where represented as such;
- It does not infringe another person’s rights;

- You engage in fraud or unlawful conduct;
- Your actions threaten the security of the Services;
- Your conduct may expose us or another person to harm or liability; or
- We are required to do so by law.
Termination does not affect any rights or liabilities that arose before termination.
40. Changes to our Services
We may modify, suspend or discontinue part of our Services.
A change will not affect an order we have already accepted unless:
- You agree to the change;
- The change is required for safety or legal compliance;
- Performance becomes impossible due to circumstances outside our reasonable control; or
- The change is otherwise permitted by law.
Where a material change affects a paid order, we will provide any remedy required by law.
41. Amendments to these Terms
We may update these Terms to reflect changes to our:
- Business;
- Products;
- Services;
- Technology;
- Operating practices; or
- Legal obligations.
Updated Terms take effect when published or on the later effective date stated in them.
Changes apply prospectively and will not retrospectively remove rights that have already accrued. We will provide additional notice or obtain consent where required by law.
42. Severability
If a provision of these Terms is invalid, unlawful or unenforceable, it will be interpreted or reduced to the minimum extent necessary to make it enforceable.
If that is not possible, the affected provision will be severed. The remaining provisions will continue to operate.
43. No waiver
If we do not immediately enforce a right under these Terms, this does not mean we have waived that right.
A waiver is effective only if it is provided in writing by an authorised representative of ZEROPLY PTY LTD.
44. Entire agreement
These Terms, together with the policies incorporated by reference and any specific conditions presented at checkout, form the agreement between you and ZEROPLY PTY LTD concerning the Services.
